Terms of Service

1. Services Offered

Huaco Landscape & Irrigation provides professional outdoor services to residential and commercial customers in Waco, Texas and the surrounding McLennan County area, including but not limited to:

• Landscape Design & Installation
• Irrigation System Installation, Repair & Backflow Testing
• Sprinkler System Installation & Repair
• Lawn Care & Maintenance
• Hardscaping, Retaining Walls & Vinyl Grading
• Tree Care, Tree Removal & Stump Grinding
• Land Clearing

All services are subject to availability, site conditions, and applicable local regulations. We reserve the right to decline or discontinue any service at our discretion.

2. Quotes & Estimates

We provide free, no-obligation quotes upon request. All quotes are:

• Based on information provided at the time of inspection and subject to change if site conditions differ.
• Valid for 30 days from the date issued unless otherwise stated in writing.
• Not a binding contract until a written service agreement or work order is signed by both parties.

3. Scheduling & Cancellations

Our standard business hours are Monday–Friday 8:00 AM–5:00 PM and Saturday 7:00 AM–12:00 PM. We are closed on Sundays.

• Cancellations must be submitted at least 24 hours before the scheduled appointment to avoid a cancellation fee.
• We reserve the right to reschedule due to inclement weather, equipment issues, or circumstances beyond our control, and will notify you as promptly as possible.
• Repeated no-shows or last-minute cancellations may result in a prepayment requirement for future bookings.

4. Payment Terms

• Payment is due upon completion of services unless otherwise agreed in a written contract.
• For larger projects, a deposit of up to 50% may be required prior to commencement of work.
• Accepted payment methods will be communicated at the time of invoicing.
• Overdue balances may be subject to a late fee of 1.5% per month on the outstanding amount.
• In the event of non-payment, we reserve the right to pursue collection through all lawful means, including filing a contractor's lien in accordance with Texas law.

5. Customer Responsibilities

To ensure safe and efficient service delivery, customers agree to:

• Provide accurate information about the property, including the location of underground utilities, irrigation lines, and any known hazards.
• Mark or disclose underground utility locations prior to any digging or excavation. Texas law requires calling 811 before digging.
• Ensure reasonable access to the work area on the scheduled service date.
• Keep pets and people away from active work zones for safety.
• Obtain any required permits or HOA approvals before work begins, unless we have expressly agreed in writing to handle permitting on your behalf.

Huaco Landscape & Irrigation is not liable for damage to unmarked underground utilities, structures, or objects not disclosed prior to commencement of work.

6. Licensing & Insurance

Huaco Landscape & Irrigation operates with all required state and local licensing. Our licensed professionals include:

• Jose Gonzalez — Irrigator License No. LI0019027
• Luis Gonzalez — Backflow Prevention Assembly Tester License No. BP21328

We carry general liability insurance and workers' compensation coverage as required by applicable law. Proof of insurance is available upon request.

7. Limitation of Liability

To the fullest extent permitted by Texas law, Huaco Landscape & Irrigation's total liability for any claim arising out of or related to our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.

We are not responsible for:

• Indirect, incidental, or consequential damages of any kind.
• Damage caused by pre-existing conditions, undisclosed hazards, or inaccurate information provided by the customer.
• Delays caused by weather, supply chain issues, or circumstances beyond our reasonable control.

8. Warranty & Satisfaction Guarantee

• Workmanship is warranted against defects for 90 days from the date of service completion, unless a separate written warranty is provided.
• Plant and living materials are subject to a 30-day establishment period. Survival beyond that period depends on proper customer care, watering, and weather conditions outside our control.
• Warranty claims must be submitted in writing within the applicable warranty period.
• Warranty does not cover damage resulting from customer neglect, misuse, acts of nature, or third-party interference.

9. Intellectual Property

All content on huacolandscape.com — including text, images, logos, videos, and design elements — is the property of Huaco Landscape & Irrigation, LLC and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use any content from this website without our prior written consent.

10. Privacy

Your use of our website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We respect your privacy and will not sell or share your personal information with third parties except as necessary to deliver our services or as required by law.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in McLennan County, Texas.

We encourage customers to contact us directly to resolve any concerns before pursuing formal legal action.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms.
